Executive Summary

Florida Bulldog's October 2025 investigation revealed $6,001,679,519.37 across 719 contracts issued by the Executive Office of the Governor - all marked "emergency procurement" - where no contract documents were uploaded to the state's legally mandated transparency portal (FACTS).

Florida Statute 215.985 (Transparency Florida Act) requires agencies to upload contract documents within 30 days of signing. All 719 contracts show Contract Uploaded? = FALSE in the database. Without the actual contracts, the public cannot verify: scope of work, deliverables, payment terms, or performance requirements.

On November 3, 2025, the Joint Legislative Auditing Committee approved a report claiming compliance with transparency laws - with less than one minute of discussion and zero questions asked.

Legal Framework

THE REQUIREMENT

Florida Statute 215.985 (Transparency Florida Act) mandates: "Within 30 calendar days after executing a contract, each state entity shall post the following information relating to the contract on the contract tracking system."

THE ENFORCEMENT GAP

The statute contains NO explicit penalties for non-compliance. No fines, no sanctions, no criminal liability, no personal accountability for officials, no mechanism to compel compliance. An agency can violate it for years with zero consequences.

EMERGENCY POWERS INVOKED

All 719 contracts cite: "Emergency procurement per Executive Order [s. 252.36(2), F.S.]"

This statute allows the Governor to suspend competitive bidding, award no-bid contracts, and bypass normal procurement oversight.
